Court Dismisses $15,000,000 Suit Against Eastland County Authorities

A lawsuit filed in October 2009 alleged various Eastland County authorities violated the constitutional rights of defendants Johnnie P Grimes and Jimmy Dool, Jr, both of Eastland.

The suit named as defendants Russell Thomason, Wayne Bradford, Joe King, III, Ray Darden, Cecil Funderburgh, Eastland County, and the City of Eastland.

On June 28, 2010 judge Sam R. Cummings dismissed the suit with prejudice. The ruling by Judge Cummings means that the suit cannot be refiled against the same defendants based on the same facts.

At issue was property seized during a drug bust at the Grimes residence in 2007 and other constitutional claims.

On April 25, 2007, Grimes and Dool were indicted for possession of methamphetamine and marihuana. After the indictment, officials in Eastland County proceeded with a series of forfeiture actions concerning property seized during the execution of the search warrant. Among the items seized were weapons, vehicles and over $9,000 cash all belonging to Grimes and a vehicle owned by Dool.
